1. Eligibility: Fieldtrip’s Earth Day Giveaway (the “Giveaway”) is open only to legal residents of the fifty (50) United States (and the District of Columbia), who are at least eighteen (18) years old at the time of entry. Promotion is in no way sponsored, endorsed, or associated with Instagram, TikTok or other social media sites or associations. Full terms and conditions apply. Officers, directors, members, and employees of Fieldtrip and the immediate family (spouse, parents, siblings, and children) and household members of the above are not eligible to enter the Giveaway or win a prize. The Giveaway is subject to all applicable U.S. federal, state, provincial, municipal, territorial, and local laws, and regulations. Void outside the U.S. and where prohibited by law. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Giveaway. 3. Timing: Fieldtrip’s Earth Day Giveaway begins on April 10, 2023, at 1:00 PM CST and ends on April, 20, 2023, at 1 PM CST (the "Promotion Period"). Sponsor’s computer is the official time keeping device for this Giveaway.
4. How to Enter: There are (2) ways to enter the Giveaway, via @fieldtripskin Instagram and TikTok. During the Promotion Period, LIKE @fieldtripskin’s Instagram post featuring Fieldtrip’s Earth Day Giveaway, FOLLOW @fieldtripskin and @amborellaorganics on Instagram and TAG a friend in the comments section of the post. Or, on TikTok, like @fieldtripskin’s post, FOLLOW @fieldtripskin and @amborellaorganics on TikTok and TAG a friend in the comments section of the post. Upon submission of the tag, you automatically will receive one (1) Giveaway entry. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The winner may be required to show proof of being the authorized account holder. All entries become the exclusive property of Sponsor, and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due entries, which will be disqualified. Failure to comply with these instructions, fill in all required fields, provide true and accurate information and abide by these Giveaway Official Rules will result in disqualification.
5. Prize Drawing: Sponsor will randomly select one (1) recipient from all eligible entries received during the Promotion Period, on April 21, 2023. Winner will be notified by a direct message via Instagram or TikTok, using the information provided at the time of entry. Winner is requested to confirm his/her mailing addresses within 2 days via return direct message via Instagram or TikTok. The potential winner (or parent/legal guardian if a winner is under the age of majority in his/her place of residence) may be required to sign and return an Affidavit or Declaration of Compliance, Liability and Publicity Release ("Declaration"), which must be received by Sponsor within seven (7) days of the date notice or attempted notice is sent, in order to claim his/her prize. If the winner is not of the age of majority in his/her jurisdiction of residence, his/her prize will be delivered to such winner’s parent/legal guardian and awarded in the name of his/her parent/legal guardian. If a potential winner cannot be contacted within five (5) calendar days of first notification attempt, if any winner fails to sign and return the Declaration or provide any other requested information within the required time period, if any prize or prize notification is returned as undeliverable, if any winner rejects his/her prize or in the event of noncompliance with these Giveaway Official Rules and requirements, such prize will be forfeited and an alternate winner may be selected from all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. Prizes will be sent to the address on the entry form or address provided via email within 4-6 weeks of winner being verified. Upon prize forfeiture, no compensation will be given.
6. Prize: One (1) winner will be selected to receive a Giveaway Prize Package with an approximate value of approximately $93. All items will be selected by Fieldtrip in their sole discretion. Winner will not receive the difference between actual and approximate retail value. Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize or a prize component for one of equal or greater value if the designated prize or prize component should become unavailable for any reason. Odds of winning the Giveaway prize depend on the number of eligible entries received during the Promotion Period. The winner will be solely responsible for all taxes and all other fees and expenses not specified herein associated with the receipt and use of the Grand Prize. Unclaimed prizes will not be awarded. Prize will be shipped via UPS and the winner will be provided a tracking number. Once the prize is with the carrier, Fieldtrip is not responsible for lost or stolen packages or for packages damaged in transit. Prize is a one-of-a-kind item and will not be replaced if lost, damaged, or stolen during transit. Without limiting the generality of the foregoing, such prizes are provided “as is” without warranty of any kind, either express or implied, and sponsor hereby disclaims all such warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and/or non-infringement.
7. Publicity: Except where prohibited, participation in the Giveaway and acceptance of prize constitute winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state or province for promotional purposes in any media, worldwide, without further payment or consideration, notice, review, or approval.
8. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Giveaway, or any part of it, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Giveaway, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision or any other rights that Sponsor may have.
9. Release: By participating, entrants and winners agree to release, indemnify and hold harmless Sponsor and its parent, subsidiary and affiliated companies, successors, assigns, partners, suppliers, manufacturers or distributors of Giveaway materials and advertising/promotion agencies and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, for any loss, harm, damage, injury, cost or expense whatsoever, including, without limitation, personal injury, death, or damage to or loss of property, arising out of or in connection with preparation for, travel to or participation in the Giveaway or possession, acceptance, receipt, use or misuse of any prize or participation in any Giveaway related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.
10. Limitations of Liability: The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Giveaway; (b) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in cellular networks, phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Giveaway; (d) technical or human error which may occur in the administration of the Giveaway or the processing of entries; (e) mail, entries, prize claims or notifications that are late, lost, undeliverable, damaged, incomplete, illegible, unintelligible, stolen or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind, including but not limited to, inactive email accounts or an entrant's failure to monitor his/her email account; or (f) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Giveaway, if it is possible. If the Giveaway, or any part of it, is discontinued for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
11. Disputes: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the state or federal courts located in Dallas County or the City of Dallas, Texas; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys’ fees; (c) entrant waives all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Giveaway; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
12. Entrant's Personal Information: Information collected from entrants is subject to the Sponsor’s Privacy Policy. By participating in the Giveaway, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.
